Waiver - Aero Global Aviation Academy

This is a legally binding document. Do not sign unless you wish to be bound by its terms.

In consideration, and as a condition of being allowed to participate in the Introductory Flight provided by Aero Global Aviation LLC, doing business as Aero Global Aviation Academy (hereafter “AGA Academy”), together with its agents, owners, officers, directors, principals, volunteers, participants, clients, customers, invitees, employees, independent contractors, insurers, facility operators, land and/or premises owners, and any and all other persons and entities acting in any capacity on its behalf, I hereby acknowledge and agree to the following:

Participant Eligibility

1. I am a competent adult aged 16 years or older.

2. In the event this agreement is signed on behalf of a child under the age of 16 (“child”), I confirm that the child’s full name and age are printed above, and that:

I am the parent or legal guardian of that child

I am a Responsible Adult who has been granted permission by the child’s parent(s)/guardian(s) to assume responsibility and sign this agreement on their behalf.

Acknowledgment of Participation

3. I understand that this agreement will be used by AGA Academy and will govern my (or the child’s) actions and responsibilities while participating in the Introductory Flight.

4. Participation is voluntary, and I (or the child) am acting under my own free will.

5. I acknowledge that participation in the Introductory Flight involves inherent risks, including but not limited to serious bodily injury, permanent disability, paralysis, or death. These risks cannot be eliminated entirely without altering the essential nature of the activity.

6. I acknowledge that additional risks and dangers may exist that are not obvious or reasonably foreseeable at this time.

Safety and Conduct

7. To reduce risks, I agree (and, if applicable, will ensure the child agrees) to follow all rules, safety policies, and instructions provided by AGA Academy, both in writing and verbally, before and during the Introductory Flight.

8. I confirm that I (or the child) have no medical or health conditions that would make participation unsafe for myself (or the child) or others. Any medical concerns have been disclosed to AGA Academy in advance.

9. I accept full responsibility for my own (or the child’s) conduct and actions while participating.

Waiver of Liability

10. AGA Academy will only accept liability for injury, loss, or damage caused by its failure to carry out obligations under this agreement or by negligence under applicable law. AGA Academy is not liable for:

Injury or loss caused by my own fault,
Injury or loss caused by third parties not acting on behalf of AGA Academy, or
Events that could not reasonably have been foreseen or prevented even with reasonable care.

11. Except as outlined above, I agree to indemnify, hold harmless, and not to sue Aero Global Aviation LLC / AGA Academy for any claims, demands, or liabilities arising from participation in the Introductory Flight or incidental activities, whether caused by negligence or otherwise.

12. I accept that I am fully responsible for all medical expenses incurred as a result of any injury or property damage during my (or the child’s) participation.

Media & Consent

13. I consent to AGA Academy taking photographs, video, or digital recordings of me (or the child) during the Introductory Flight and using them for training, promotional, or safety purposes without compensation. I waive the right to review or approve such materials.

14. I consent to receive emergency medical treatment deemed advisable in the event of accident, injury, or illness during participation.

General Provisions

15. This agreement constitutes a permanent waiver and release of liability with respect to myself (and, if applicable, the child). Revocation requires prior written approval from AGA Academy.

16. This waiver is intended to be as broad and inclusive as permitted under the laws of the State of Florida. If any portion is found invalid, the remainder shall remain enforceable.

17. This agreement is governed by the laws of the State of Florida, and any legal proceedings shall take place in Florida.

18. While AGA Academy takes all reasonable precautions to ensure participant safety, I acknowledge that accidents may occur and that it is my responsibility to minimize risks by complying with all rules, safety instructions, and guidelines.

By choosing Yes, I acknowledge that I have read and fully understood this agreement, and I voluntarily accept its terms on behalf of myself (and/or the child).
